It's International airspace. Until it becomes THEIR airspace, anyone and everyone is free to use it with or without their permission.
And it absolutely IS aggression when you pull up next to another aircraft and show them your weapons or buzz them. For military planes to be doing this requires specific orders/authorization to do so.
