It is only because the Tea Party widely uses this flag. The pulling of the race card has always been about intimidating conservatives into shutting up and sitting down.
I am no longer a Tea Party member, but I find calling the iconic Gadsden flag "offensive" as being very offensive to me.

It makes me wonder, what if there was a mass civil disobedience movement to file complaints against Black Lives Matter for being a racist organization? It could short-circuit the DOJ and other agencies with a flood of paradoxical paperwork. (Using the system against itself.)

Ah, you're talking about the sort of old-fashioned Americans the current regime told the "not a smidgen of corruption" IRS and other agencies to
    give a hard time.

The Liberal, Progressive Democrat Party thinks anything that indicates individualism, self reliance and individual honor is racist.
Things like that (Don't Tread on Me) indicate such things and , according to the LPDP are not acceptable. It make actually make people free and equal as opposed to oppressed and unequal.
If racists have marched under it, it is to therir dishonor and shame, not the flags.

If racists did march under this flag, that's ironic. People opposed to racism should reclaim it: Don't tread on me.

Should libs want to fly the hammer and sickle flag, I would just consider that as being honest.
