Not that I would EVER break any law whatsoever regardless of how irrational, but there is virtually no chance of prosecution even where it is unlawful.
Now if you start selling it, that's another set of irrational laws with many more mindless drones who love to enjoy any level of power over their fellow man. Then the risk is significantly higher.

Those laws will not be changed by voting, and unless you have amassed a fortune to bribe, er, make campaign contributions, you won't get the laws changed within the system.

"We, the people", are instead "we, the serfs", unless we resist.

Indeed. I used to brew my own, but have not found the time of late. Home-brew is awesome. One of my younger brothers still puts up a few batches every year. mmm, mmm good!

I just make more and refill the bottles. Home made is better than industry standard.
Better product, supports local brewshop, and there is no BATF TAX to pay.
